Announcement of the Ministry of Commerce No. 56 of 2008 Notice Concerning the Application for the Export License of Citric Acid and Ferroalloy

In order to promote the pilot reform of export commodity management methods, in line with the implementation of the ferroalloy industry policy and the discharge standards for major pollutants of citric acid production enterprises, the export management of ferroalloys and citric acid (salt) products will be strengthened and regulated, in accordance with the Foreign Trade Law of the People's Republic of China. The relevant provisions of the "Regulations on the Administration of Import and Export of Goods of the People's Republic of China" are hereby announced as follows:
1. Starting from September 1, 2008, it began to implement the "Conditions and Procedures for the Application of Ferroalloy Export Licensing Approvals" and the "Application Conditions and Procedures for the Application for Citric Acid and Citric Acid Salt Export Licenses".
2. Enterprises exporting the commodities covered by this announcement shall be subject to the "Measures for the Administration of Export Licenses of Goods" (Decree No. 11 of 2008 of the Ministry of Commerce) and "Catalogue of Goods for Export License Administration in 2008" (Ministry of Commerce and General Administration of Customs of the People's Republic of China in 2007). Announcement No. 101) The relevant provisions, and in accordance with the above two conditions and procedures for application, submit the relevant application materials to the local competent commercial authorities at the provincial level. The relevant provincial competent commerce department shall submit a formal application or recommendation material (with company application materials) to the Ministry of Commerce (Foreign Trade Department) before October 15, 2008, and copy it to the China Minmetals Chemicals Import and Export Chamber of Commerce.
3. The list of companies that have been approved by the Ministry of Commerce to confirm the conditions for applying for export licenses for relevant commodities will be announced on the website of the Ministry of Commerce. Export enterprises that have the relevant requirements for the application shall apply for export licenses issued by the provincial-level (provincial, autonomous region, municipality directly under the Central Government, separately listed cities under the plan, Xinjiang Production and Construction Corps) authorized by the Ministry of Commerce.
4. Starting from January 1, 2009, the “Circular on Issues Concerning Issuance of Citric Acid and Silicon Ferromanganese Export Licenses issued by the General Office of the Ministry of Commerce†(Business Office [2008] No. 2) has been suspended.
V. The Ministry of Commerce is responsible for the interpretation of this announcement.
