Electric Bike Laws in the U.S.
The federal government first regulated electric bike laws in 2002. Since then, these laws have evolved significantly, with variations between states and even counties within the U.S. Currently, 26 states have adopted a three-tiered classification system for electric bikes.
These states share a common language for defining electric bicycles and have similar requirements for their safety and operation. New Jersey and West Virginia, on the other hand, follow a two-tiered classification system.
When purchasing an electric bike in the U.S., it’s important to be aware of the three-tiered classification system that has been created to ensure transparency for manufacturers. For the convenience of consumers, three primary classes were established. Let’s take a closer look at the e-bike classes in the U.S. Class 1 includes electric bikes with a top speed of up to 20 mph and pedal assist. Class 2 refers to electric bikes with a throttle assist and the same speed limit. Class 3 consists of high-speed electric bikes with speeds up to 28 mph and pedal assist.
Electric Bike Laws in Different States
While some states are still grappling with the legality of e-bikes, others have embraced the three-tiered system to give riders more freedom.
In California, known for its breathtaking coastal views, the aforementioned classification system is in place. Riders in California don’t need a driver’s license to operate a private electric vehicle. However, if you’re riding a Class 3 e-bike, wearing a helmet is mandatory. One controversial issue is riding electric bikes on sidewalks in California. While there is no statewide ban on cycling on sidewalks, local regulations may prohibit biking on sidewalks in commercial areas of cities.
Florida’s electric bike laws permit riding on sidewalks. Since the Electric Bike Classification Act was passed in July 2020, the state now follows the same rules as California. E-bikes no longer require registration, and riders don’t need auto insurance or a government license. Still, it’s wise to review the specific rules for using e-bikes in Florida before hitting the road. Riders under 16 are prohibited from operating an electric bike.
E-bikes and scooters became legal in New York State in 2019. Over the past two years, the number of people switching to e-bikes has surged. With the ongoing pandemic, it’s anticipated that personal electric transportation will become a common practice among residents.
