Why Do States Require Ignition Interlock Devices?

    Over the last 15 years, states across the U.S. have increasingly embraced the use of ignition interlock devices (IIDs) to monitor drivers with DUI convictions or suspended licenses. These devices, which function similarly to a breathalyzer, are directly linked to a car's ignition system. Before starting the vehicle, the driver must first blow into a mouthpiece to check their blood alcohol concentration (BAC). If the BAC is below the legal limit, the car can be started. If it exceeds the limit, the IID prevents the car from starting until the driver provides a legal BAC reading. Some IIDs also require rolling retests. In such cases, the driver must provide another breath sample while driving to ensure no one else provided the initial sample. The IID doesn't immediately shut down the vehicle if the BAC is too high; instead, it records the event and alerts the driver to pull over. This information is then sent to the Department of Motor Vehicles (DMV). By 2020, all 50 states had implemented IID laws for drunk driving offenses. New Mexico was the pioneer, adopting the first such law in 2005. Initially, the state mandated all DUI offenders to install an IID. From 2006 to 2017, this measure led to a significant decline in drunk driving incidents. According to statistics, IIDs successfully prevented over 70,000 instances of drunk drivers from taking to the roads. Other states followed suit, though some began with more lenient requirements. For example, certain states only enforce IIDs for repeat DUI offenders, while others, like Connecticut, have adopted "all-offender" laws, requiring even first-time DUI offenders to install an IID. Studies show that all-offender states experience a greater reduction in DUI offenses and related fatalities. Currently, 34 states and Washington D.C. have all-offender laws in place. In Connecticut, an IID is not solely required for DUIs. Drivers also need this device to regain their license if they: - Failed or refused a chemical alcohol test. - Were found operating a vehicle under the influence of drugs. - Committed vehicular assault or manslaughter. The Centers for Disease Control and Prevention (CDC) reported that installing IIDs reduces DUI offenses by 70%. However, the CDC highlights the challenge of ensuring compliance among those with DUI convictions. Mothers Against Drunk Driving (MADD) reached similar conclusions, finding that IIDs reduce repeat DUI offenses by 67%, lower drunk driving fatalities by 15%, and serve as the most reliable method to keep impaired drivers off the road. Certain states offer hardship or restricted licenses to DUI offenders, allowing limited driving privileges such as commuting to work or school. To qualify for this, states require the installation of an IID. Massachusetts provides an example of stricter DUI penalties. In 2005, the state introduced Melanie’s Law, increasing penalties for DUI offenses and establishing an IID program for repeat offenders. The law also included new guidelines for suspending or revoking licenses. In Connecticut, after completing the suspension period and meeting all restoration requirements, a driver with a DUI conviction can regain their license only if an IID is installed. They'll receive a restoration notice, need a valid license, and must maintain the IID for a specified period. One of the most important aspects of IIDs is the data they collect. For instance, the number of starting attempts can indicate how committed a driver is to staying sober. Rolling tests combined with GPS technology track the driver's location if their BAC is too high. Cameras ensure the person blowing into the mouthpiece is the driver. This data isn't immediately available. The driver must bring their vehicle in for IID maintenance every 30 to 90 days. During these visits, the device is calibrated, and all stored data is sent to the DMV or relevant authority. Technicians check for signs of tampering or altered data. Monthly reports help determine when a driver might be eligible to regain their license.
